Missouri Driver’s License Suspensions

Missouri Driver License Suspension Information

If you have been arrested for your first DWI, took the breath test, and the results were over the legal limit of 0.08%, then you will face a 90 day suspension of your driving privileges.

After the first 30 days of the suspension you will most likely be eligible for a Restricted Driving Privilege to drive to and from work, but only if you have an SR-22 insurance policy on file with the State of Missouri.

If you have been arrested for your first DWI and refused to take the breath test, then you will face a one year suspension of your driving privileges.

After the first 90 days of the suspension you may be eligible for a restricted driving privilege to drive to and from work, but only if you have an SR-22 insurance policy on file with the State of Missouri.

After a person has one DWI the suspension lengths increase and also become more complicated.

If you are convicted of two DWI’s within a 5 year period, then your driving privileges will be revoked for a period of 5 years.

Another example is if you have two driving suspension arising from DWI arrests on your driving record then you will need to have an Ignition Interlock device installed on your vehicle for six months as a requirement to get your driving privileges fully reinstated.

Missouri License Reinstatement Requirements

In order to be reinstated after your first driver’s license suspension arising out of a DWI arrest you will have to complete three reinstatement requirements to get your full driving privileges back:

  1. Complete the SATOP class. SATOP is an acronym for Substance Abuse Traffic Offenders Program.
  2. Obtain an SR-22 insurance policy and make sure it is on file with the State of Missouri.
  3. Pay a $45 reinstatement fee to the Missouri Department of Revenue.

Fighting the Suspension of Your Driving Privileges

It is important to fight any possible suspension of your driving privileges from the outset, especially when that suspension arises out of a DWI arrest.

It is best to speak with a DWI attorney regarding how to challenge a suspension, the length of a possible suspension, and the reinstatement requirements that may be necessary to get your full driving privileges restored after a suspension.
